PROCLAMATION OF SALE

 

            Whereas the undersigned has drawn up the certificates mentioned in the Annexure – A, for the recovery of the sum of Rs.5,52,32,136/- from M/s. Hope Plantations Limited, ( A division of Poddar Udyog Ltd ), Peermade,  Idukki (defaulter) excluding costs, charges and expenses of the proceedings of the recovery thereof:

 

            And whereas the undersigned, in exercise of the power conferred on me under Section 8B of the Employees’ Provident Funds and Miscellaneous Provisions Act 1952, read with the notification No. S. O. 796 dated 4th March, 1997, issued by the Government of India, has ordered the sale of the attached property mentioned in the annexed schedule in satisfaction of the said certificates:

 

            And whereas on the 21-04-2009 there will be due thereunder a sum of Rs.5,52,32,136/-, excluding costs and interest.

 

            Notice is hereby given that, in the absence of any order of postponement, the said property shall be sold by the Enforcement Officer, Idukki by public auction at 11 A.M. on the said 21-04-2009 at Employees’ Provident Fund Organisation, Sub-Regional Office, Chalakuzhy Building, CMS College Road, Kottayam.

           

The sale will be of the property of the defaulter above named as mentioned in the schedule below and the liabilities and claims attached to the said property, so far as they have been ascertained, are those specified in the schedule.

 

            The sale will also be stopped if, before any lot is knocked down, the arrears mentioned in the said certificates, interest payable under Section 7Q of the Employees’ Provident Fund and Miscellaneous Provisions Act, 1952 and costs (including the costs of the sale) are tendered to the officer conducting the sale or proof is given to his satisfaction that the amount of such arrears, interest and costs has been paid to the undersigned.

 

            At the sale, the public generally is invited to bid either personally or by duly authorised agent.  No officer or other person having any duty to perform in connection with this sale shall, however, either directly or indirectly bid for, acquire or attempt to acquire any interest in the property sold.

 

 

 

 

          The sale shall be subject to the conditions prescribed in the Rules laid down from time to time and to the following further conditions.

 

(i)                 The particulars specified in the annexed schedule have been stated to the best of the information of the undersigned, and shall not be responsible for any error, mis-statement or omission in this proclamation.

 

(ii)               The persons who are intending to take part in the auction may register their names with Assistant Provident Fund Commissioner ( Recovery), Sub-             Regional Office, Kottayam  before the  commencement of auction date and  to deposit 10% of the Minimum Reserve Price, either by Demand Draft in favour of the Regional Provident Fund Commissioner, Kottayam or by cash, which is refundable in case the  auction is not fixed in their favour.

 

iii)                The reserve price below which, the property shall not be sold, is shown in column 1 of the annexed schedule.

 

(iv)       The officer conducting the sale shall determine the amounts by which bidding is to be increased.  In the event of any dispute arising as to the amount bid, or as to the bidder, the lot shall at once be again put up to auction.

 

(v)               The highest bidder shall be declared to be the purchaser of any lot provided that he is legally qualified to bid and deposited 25% of the auction price on the spot to the Officer conducting the sale and in default of such deposit, the property shall forthwith be put up again and resold. The balance amount of the purchase money payable shall be paid to the undersigned on or before 15 days from the date of sale of the property.

It shall be the discretion of the undersigned to either cancel or postpone the auction without assigning any reason whatsoever or to decline acceptance of the highest bid when the price offered appears to be inadequate to the undersigned.

 

(vi)             For reasons recorded, it shall be in the discretion of the officer conducting the sale to adjourn it subject always to the provisions of the Rules laid down from time to time.

 

(vii)           The purchaser will have to take possession of the Estate as it is and where it is condition. The Recovery Officer shall not be answerable for any difference in above order or measurement

 

(viii)    The confirmation of sale will be given only after 30 days of the sale of the

immovable property.

 

(ix)       1% of the bid amount is to be deposited as poundage fee.
